End User License Agreement (EULA)

1. License

MannaMedia grants you a limited, non-exclusive, non-transferable, revocable license to download and use the MannaMedia Creator mobile application (the "App") on a device you own or control, solely for your personal use in accordance with this EULA, our Terms of Service, and the usage rules of the app store from which you obtained the App. This is a license, not a sale; MannaMedia and its licensors retain all rights not expressly granted.

2. Eligibility

You must be at least 18 years old to use the App. The App is not directed to children.

3. User-generated content and conduct rules

The App is a marketplace involving user-generated content ("UGC") — including posts you submit, captions, profile details, and messages to support. As a condition of using the App:

  • You are responsible for content you submit and must own or control it.
  • No objectionable content. You will not create, upload, submit, or promote content that is illegal, hateful, harassing, threatening, defamatory, obscene, sexually exploitative, or otherwise objectionable.
  • No abusive behavior. You will not harass, threaten, impersonate, or abuse other users, brands, or staff.
  • Follow the Terms of Service. All conduct rules and prohibited-conduct provisions in our Terms of Service apply here.

3.1 Zero tolerance (Apple Guideline 1.2 for UGC)

MannaMedia maintains a zero-tolerance policy for objectionable content and abusive users. To that end, the App provides:

  • a mechanism for users to flag/report objectionable content (in-app "Report");
  • a mechanism to block abusive users (in-app "Block");
  • a process for MannaMedia to review reported content and remove it, and to eject the user who provided it, within a commercially reasonable time (target: within 24 hours of a report).

By using the App you agree there is no tolerance for objectionable content or abusive behavior, and that violations may result in immediate content removal and account termination.

4. Restrictions

You may not: copy, modify, or create derivative works of the App; reverse-engineer, decompile, or disassemble it except as permitted by law; rent, lease, lend, sell, or sublicense it; remove proprietary notices; use it to violate any law or third-party right; or use it to build a competing product.

5. Apple-specific terms

This Section applies if you obtained the App from the Apple App Store. It supplements, and where required by Apple governs, the rest of this EULA.

  • Scope. This EULA is between you and MannaMedia only, not with Apple. MannaMedia, not Apple, is solely responsible for the App and its content.
  • License scope. The license is limited to a non-transferable license to use the App on any Apple-branded products you own or control, as permitted by the App Store Usage Rules, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing where applicable.
  • Maintenance and support. MannaMedia is solely responsible for maintenance and support. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. To the maximum extent permitted by law, Apple has no warranty obligation for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation, and any other claims are MannaMedia's responsibility.
  • Product claims. MannaMedia, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory non-compliance, and consumer-protection claims.
  • Intellectual property. In the event of a third-party claim that the App infringes intellectual property rights, MannaMedia, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, the terms of the social platforms you connect).

6. Disclaimers and limitation of liability

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, MannaMedia disclaims all implied warranties and will not be liable for indirect, incidental, or consequential damages. The disclaimers and limitation of liability in our Terms of Service apply to the App.

7. Termination

This license is effective until terminated. It terminates automatically if you breach it. On termination you must stop using the App and delete it. You may delete your account in the App at any time (Profile → Danger zone → Delete account).

8. Governing law

This EULA is governed by the laws of the State of Tennessee, USA (working default), except that the Apple-specific terms in Section 5 are construed consistently with Apple's requirements. *(Attorney to confirm governing law and its consistency with the Terms of Service.)*
